A Mt. Vernon man has been sentenced in Posey County.Robert E. McCarty, age 38, appeared in the Posey County Circuit Court where he was sentenced by
Judge Craig Goedde to 35 years in prison after pleading guilty to multiple charges, including dealing in methamphetamine, unlawful possession of a firearm by a serious violent felon, as well as the habitual offender enhancement.
As part of his guilty plea, McCarty admitted to possessing a firearm, as well as approximately 190 grams of methamphetamine in Posey County on January 19, 2022 with the intent to deliver the illegal drugs. McCarty further admitted to being classified as a habitual offender under Indiana law with multiple prior felony convictions, including battery resulting in moderate bodily injury in 2018, dealing in methamphetamine in 2015, theft in 2012, and auto theft in 2008. According to the Probable Cause Affidavit, while law enforcement with the Indiana State Police were executing a search warrant on McCarty’s residence and vehicle, they located the suspected methamphetamine and over $7,000 in cash. During the search of McCarty’s residence, officers also discovered and seized a Hi-Point .45 caliber rifle.
According to Posey County Prosecutor Thomas Clowers, McCarty is unable to lawfully possess firearms due to being classified as a serious violent felon as a result of a prior conviction for dealing in methamphetamine. Prosecutor Clowers further praised the work of law enforcement: “Thanks to a thorough investigation conducted by our local law enforcement, a drug dealer and serious violent criminal has been removed from our community for a significant period of time.”
McCarty will be transported to the Indiana Department of Correction to serve his sentence.
