A written judgement is forthcoming concerning the records of Kristy Kelley’s death.
At a hearing today (Tuesday) in Boonville, a judge heard arguments that the records should be released to the petitioner, Kelley’s father Todd Scales, exclusively for a time before they are made available to the public.
Scales has said he asked for exclusivity because he wants to preserve the chain of evidence in case he wishes to appoint a special prosecutor and move forward.
Opponents say the law doesn’t make provision for exclusive release; nor, says Scales’ attorney, does it make a case for exclusivity.
The ruling should come down within a week.
